By accessing or using the WorkoutAI web application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, please do not use the Service.

By submitting User Content, you grant WorkoutAI a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
    

5. Prohibited Uses
   
   You agree not to use the Service in any manner that:

   b. Infringes upon the rights of any third party, including copyright, trademark, or privacy rights;

   In no event will WorkoutAI, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service.

9. Governing Law and Jurisdiction
   
   These Terms shall be governed by and construed in accordance with the laws of California. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts located in California, San Bernardino County.
